Welcome to KidBites. These Terms of Service ("Terms") govern your use of the KidBites mobile application and website (collectively, the "Service") operated by KidBites ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Description of Service

KidBites is a meal tracking application designed to help co-parents monitor and share information about their children's meals. The Service includes:

• Meal photo capture and logging
• AI-powered nutritional analysis and scoring
• Real-time notifications to co-parents
• Weekly meal reports and summaries
• Multi-child profile management

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to enter into these Terms
• You are a parent or legal guardian of any children whose information you add to the Service
• You have the legal right to share meal information with any co-parents you invite

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Co-Parent Sharing

KidBites allows you to share meal information with co-parents. By inviting a co-parent:

• You represent that you have the legal right to share your child's meal information with that person
• You understand that invited co-parents will have access to meal photos, scores, and notes
• Either parent can log meals and both will receive notifications
• You can revoke a co-parent's access at any time

5. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, or violates others' rights
• Harass, abuse, or harm another person
• Upload photos that do not depict meals (inappropriate content)
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any commercial purpose without our consent
• Upload malware or malicious code

6. AI-Powered Features

Our Service uses artificial intelligence to analyze meal photos and provide nutritional assessments. You acknowledge that:

• AI analysis is provided for informational purposes only
• Nutritional scores are estimates and may not be 100% accurate
• The Service is not a substitute for professional nutritional or medical advice
• AI technology has limitations and may occasionally misidentify foods

7. User Content

You retain ownership of all content you upload to the Service ("User Content"), including meal photos and notes. By uploading User Content, you grant us a limited license to:

• Store and display your content within the Service
• Process photos through our AI analysis system
• Share content with co-parents you have authorized
• Create anonymized, aggregated data for service improvement

You are solely responsible for your User Content and represent that you have all necessary rights to upload it.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by KidBites and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without written consent
• Reverse engineer or attempt to extract our source code

9. Subscription and Payments

Some features of the Service may require a paid subscription. If you purchase a subscription:

• You agree to pay all applicable fees
• Subscriptions automatically renew unless cancelled
• You can cancel anytime through your app store account settings
• Refunds are handled according to Apple App Store or Google Play Store policies

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Conduct that we believe is harmful to other users or the Service
• Upon your request to delete your account

Upon termination, your right to use the Service will immediately cease. You may request deletion of your data as described in our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF AI ANALYSIS

We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDBITES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Reliance on AI-generated nutritional assessments
• Disputes between co-parents

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless KidBites and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Disputes with co-parents or other users

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be:

• First attempted to be resolved through informal negotiation
• Subject to binding arbitration if negotiation fails
• Governed by the laws of the State of Delaware, USA

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for material changes

Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KidBites regarding the Service.
